Oklahomans With Criminal Records May Qualify for Relief Under New Laws

This is a paid public service announcement to inform the public of their rights under Title 22 of the Oklahoma Statutes, Section 18(A)(15)(as amended by SB 815).

Former Felony Crimes Have Been Reclassified! 

Simple drug possession and property crimes under $1,000 have been reclassified to misdemeanor offenses.

Most misdemeanor convictions can be cleared from your record after five years from the completion of your sentence. 

Now, those convicted of non-violent felonies may qualify to have their record cleared as well.

Regardless of any other prior offenses or pending charges, those reclassified offenses can be cleared (expunged) 30 days after you have completed your sentence for the crime. 

The only requirements?

- restitution must be paid in full
- any treatment ordered as part of the sentence must be completed

Find Out If You Qualify for Expungement

This change is important because it does not consider prior convictions or outstanding charges, and it provides an EXTREMELY FAST track to eligibility – just 30 days – for convictions that otherwise could not be expunged for five or even 10 years.
If you have no felony convictions and no other felony or misdemeanor charges pending, then:

  • Deferred judgments in misdemeanors can be expunged a year after the charge was dismissed.
  • Deferred judgments in nonviolent felonies can be expunged five years after the charge was dismissed.
  • Misdemeanors resulting in fines of under $501 with no jail time or suspended sentence can be immediately expunged upon payment of the fine.
  • Misdemeanors resulting in fines of more than $500 can be expunged five years after completion of the sentence.
  • A single non-violent felony conviction can be expunged five years after the completion of your sentence, so long as you have no misdemeanor convictions in the past seven years.
  • A total of two non-violent felony convictions can be expunged 10 years after completion of the sentence provided the felonies do not require registration as a sex offender.
